Statement from the Student Government Judicial Branch

Pursuant to the Student Government Bylaws, articles of impeachment that were passed at Student Government’s Feb. 18 senate meeting have been petitioned to the Supreme Court for consideration and action. Upon review and careful consideration of the articles of impeachment and consultation with University General Counsel, we determined that because the articles of impeachment are largely surrounded by President Brandt’s political ideology and associations with organizations related, impeaching him on such articles would violate his First Amendment rights as defined in the United States Constitution.

Considering that the articles are not content and viewpoint neutral we have determined that further consideration of the articles of impeachment is not within the jurisdiction of the Impeachment Court as contemplated by the Student Government Constitution. Therefore, the articles of impeachment regarding President Brant are dismissed and returned to the Senate. No further action will be taken by the court at this time.

Statement from Iowa State University

In consultation with the university General Counsel, the Student Government Judicial Branch has dismissed the impeachment articles against President Brandt because penalizing the president based on his political ideology and associations would violate his constitutional rights. The university supports this decision.

Iowa State further reaffirms its role as a First Amendment campus, committed to the constitutional protections of free expression for all sides of the political spectrum. The protections afforded by the First Amendment are core values of Iowa State and fundamental to the university’s mission to create, share, and apply knowledge to make Iowa and the world a better place.
